Many workers are faced with the problem of not being paid their correct entitlements either during the term of the employment or once they are terminated or have left the employment. This can arise from incorrect payments having regard to the relevant Award governing your employment such as the rate of pay, allowances or overtime. It may be the payment of annual leave accrued during the employment or it may be Long Service Leave or pro-rata Long Service Leave.
In most jurisdictions in Australia even if you leave the employment before Long Service Leave has accrued, after 7 years ( or even 5 years in some states) the worker is entitled to a payment. If an employer dismisses an employee where the pro-rata period is approaching and it appears that the dismissal is an attempt to avoid the payment then the employer will still be liable for the pro-rata payment.
